Publisher embed terms
Last updated: 18 September 2026. These terms govern your use of the CrossEights Daily puzzle on your website. By requesting, installing or using a CrossEights publisher embed, you agree to these terms on behalf of the organization that operates the website and confirm that you have authority to do so. Players' use of CrossEights is governed by our Terms of Use and Privacy Policy.
1. What we provide
We host and maintain a branded CrossEights Daily puzzle for your site, including a reader leaderboard and private statistics page. A new puzzle is published each day. The service is free unless we agree otherwise in writing.
2. How you may use it
You may embed the puzzle on websites we approve using the code we provide, and you may sell and keep advertising on the page around it.
You may not modify, copy, reverse engineer, scrape or redistribute the puzzle, software or data; remove or obscure CrossEights branding or links; present the puzzle as your own; sublicense it; or place ads, overlays or trackers inside the puzzle frame.
The puzzle may not be used on sites containing unlawful, hateful or adult material, or on sites directed primarily to children under 13 without our written approval.
3. Intellectual property
CrossEights™, CrossEights Daily™, the game, software, design, puzzle data, word lists, scoring system and related content belong to Beyond The Fossils or its licensors and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to display the puzzle on approved websites while these terms remain in effect. No ownership rights are transferred to you.
4. Branding
You permit us to display your publication name and any logo you provide within your puzzle edition and to identify your publication as a website offering CrossEights. Your marks remain yours, and either party may withdraw permission for promotional use of its name or logo.
5. Players and data
Players may play anonymously. We collect information needed to operate, secure and improve the game and provide publisher analytics. This may include a chosen display name, scores, completion times, device and browser information, IP address, coarse geographic information and basic game activity. We do not sell player personal information.
Publisher statistics are aggregate, except for display names and scores intentionally shown on public leaderboards. We are responsible for information collected through CrossEights; you are responsible for your website and any information you collect through it. Each party is responsible for complying with applicable privacy laws.
When the arrangement ends, publisher access to leaderboard and statistics pages may end. We may retain game and analytics data as permitted by our Privacy Policy and applicable law.
6. Availability and changes
We aim to provide reliable service but do not guarantee uninterrupted or error-free availability. We may update the puzzle, features, publisher tools or embed code.
We may also update these terms and will provide reasonable notice of material changes using the contact information you supplied. Continued use after updated terms take effect constitutes acceptance.
7. Ending the arrangement
Either party may end the arrangement at any time, for any reason, by giving notice. You may also end it by removing the embed.
We may suspend or disable the puzzle immediately if we reasonably believe your use violates these terms, creates a security or technical risk, infringes third-party rights, is unlawful or could materially harm CrossEights, Beyond The Fossils or its users.
We may also discontinue or change the availability of the free publisher service at any time. Any future paid service would require a separate agreement or your acceptance of the applicable pricing and terms.
When the arrangement ends, your licence ends and you must remove the embed. Neither party owes the other compensation merely because the arrangement has ended.
8. Your responsibilities
You confirm that you are authorized to act for the publisher, add the puzzle to the registered website and provide accurate contact information.
You are responsible for your website, content, advertising, legal notices and compliance with applicable laws.
You agree to indemnify Beyond The Fossils against third-party claims arising from your website, advertising, breach of these terms or materials you provide to us. We will be responsible for third-party claims alleging that the unmodified CrossEights puzzle, when used according to these terms, infringes third-party intellectual property rights.
9. Warranty and liability
The service is provided "as is" and "as available." We do not guarantee availability, audience, engagement, advertising revenue or other results.
To the fullest extent permitted by law, neither party is liable for indirect or consequential damages or lost profits, revenue or data. Except for liabilities that cannot legally be limited, Beyond The Fossils' total liability will not exceed $500 or, for a paid service, the amount you paid us during the preceding 12 months, whichever is greater.
10. General
The arrangement is non-exclusive, including within your geographic market. You may not assign it without our written consent; we may assign it as part of a transfer of the CrossEights business. Nothing here creates a partnership, joint venture, agency or employment relationship.
If any provision is unenforceable, the remainder stays in effect, and failure to enforce a provision does not waive it. These terms constitute the agreement governing your use of the publisher embed.
These terms are governed by Georgia law. Any dispute will be brought in a state or federal court having jurisdiction in Glynn County, Georgia, and each party consents to that jurisdiction and venue.
